注冊商標(biāo)的轉(zhuǎn)讓的限制
注冊商標(biāo)的轉(zhuǎn)讓不得違反下列限制性規(guī)定：
類似商品使用同一個商標(biāo)的，不得分割轉(zhuǎn)讓；
共同所有的商標(biāo)，任何一方共有人不得私自轉(zhuǎn)讓；
沒有依法履行轉(zhuǎn)讓法定程序的，轉(zhuǎn)讓無效，例如未經(jīng)商標(biāo)局核準(zhǔn)的轉(zhuǎn)讓行為無效；
商標(biāo)受讓人在商標(biāo)使用中，如果商品粗制濫造，以次充好，欺騙消費(fèi)者的，其轉(zhuǎn)讓可能導(dǎo)致被商標(biāo)局撤銷。
